What Happens When You’re Hit By an Uninsured Driver or Stolen Vehicle?

Approximately 4.1 million drivers in California are uninsured. Many of these uninsured are also undocumented and may not even have a proper driver’s license. If one of these drivers crashes into you, you might think that you are out of luck in getting your car repaired or having medical expenses paid for. This isn’t necessarily true.

About Uninsured Motorist (UM) Coverage

Everyone should request UM coverage in their auto policy. Uninsured Motorist coverage steps in and covers your losses in the event you are hit by an uninsured driver. Your UM coverage should include both vehicle and bodily injury provisions for maximum protection. The amount of coverage is based on how much you pay for; a minimal policy would be $15,000. It is fairly inexpensive insurance so purchase as much as you can afford.

UM will protect you in the event:

You are hit by an uninsured driver
You are hit by a stolen vehicle

In order for uninsured coverage to be in effect, you must be able to prove the vehicle that hit you was uninsured. So after an accident ALWAYS take photos of the vehicle including license plate, of the driver and his/her driver’s license. You then file DMV form SR1 to notify the DMV you were involved in an accident. You will provide your insurance info on the form and the name and address of the person that hit you. Hit and Run Accidents.

I have seen insurance companies try to get out of paying a claim through UM coverage in a hit and run when the victim could not prove the person that hit you was in fact uninsured. This is really poor customer service and a dishonest practice, but I have seen it. So, in the event of a hit and run, if it were me, I would safely follow the person and call 911 and give a description of the vehicle, license plate number and description of the driver. If possible and if safe, take a photo of the car and of the driver. Of course you would only do this if you believe it was safe to do so.

Uninsured Motorist coverage is an important policy feature that everyone should have. It is affordable and because there are so many uninsured drivers out there the odds of being hit by one is pretty good. This coverage could save you from financial losses and allow you to get needed car accident medical treatment if you are injured.
